General Terms and Conditions of Travel and Contract destinationsports AG

1. Conclusion of contract

Your verbal or written booking confirmation constitutes a contract between you and destinationsports AG (hereinafter referred to as destinationsports). These terms and conditions of contract and travel are an integral part of this contract. Furthermore, the provisions and information in the travel advertisement apply. destinationsports reserves the right to change the travel advertisement before you make your booking. If destinationsports arranges travel arrangements or individual services from other tour operators for you, you conclude the contract with that company and their own terms and conditions of contract and travel apply. For all flight tickets without additional travel services provided by destinationsports, destinationsports is not a party to the contract and the terms and conditions of the responsible airline apply exclusively. Special requests or ancillary agreements are only part of the contract if they have been confirmed in writing by destinationsports.

2. Prices and payment terms

The prices for the travel arrangements can be found in the travel brochure or price list valid at the time of booking. Unless otherwise stated in the brochure, prices are per person in Swiss francs. All prices include statutory value added tax and are cash prices. In addition, a processing fee may be charged at the time of booking. The mandatory travel insurance will be invoiced at the same time as the package. However, you can submit a waiver when booking if you already have appropriate private insurance. In this case, you are personally liable for the payment of any cancellation and extra return travel costs. If no specific payment terms apply, the travel packages must be paid for as follows before the start of the trip:

  • 30% deposit within 10 days of receiving the invoice/confirmation · Balance to be paid no later than 45 days before departure

Only tickets, individually booked services:

  • Payment within 10 days of receipt of invoice/confirmation

If you book your trip/service less than 45 days before the start of the trip, the entire invoice amount must be paid upon conclusion of the contract. If payment is not made on time, destinationsports is entitled to refuse the travel services. In this case, the trip will be considered canceled and the cancellation fees specified in section 8 will apply. Travel documents will only be sent after receipt of payment, approximately 10 days before departure.

3. Price and program changes before the trip

destinationsports reserves the right to change the travel price, the travel program, or individual agreed services before the contractual start of the trip. Articles 7–10 of the PRG apply. Price increases may only be made if transportation costs increase retrospectively, fees or charges (such as airport taxes, landing fees, taxes) are newly imposed or increased, or the relevant exchange rates change. If the change to the contract is significant, you may notify us in writing within five days of receiving notification of the change to the contract that you wish to withdraw from the contract without incurring any costs or participate in a replacement trip proposed by us. If no notification is made within five days, the change to the contract shall be deemed to have been accepted.

4. Cancellation of the trip by destinationsports

Some trips offered by destinationsports require a minimum number of participants. If this number is not reached, destinationsports may cancel the trip no later than three weeks before the scheduled departure date. destinationsports will refund the trip price you have already paid. Further claims for compensation are excluded. If, in the opinion of destinationsports, the trip is endangered, significantly impeded, or made impossible by force majeure, measures taken by the authorities, epidemics, political unrest, or strikes, destinationsports may cancel or prematurely terminate the trip. destinationsports will refund the travel price you have already paid. However, destinationsports is entitled to deduct any expenses incurred and proven, as well as a processing fee. Further claims for compensation are excluded.

5. Program changes during the trip

destinationsports reserves the right to change the itinerary or individual agreed services during the trip if unforeseen circumstances require it. If a change to the itinerary must be made during the trip that affects a significant part of the trip, destinationsports will reimburse you for any objective difference in value between the price paid for the trip and that of the services provided. Flight times are subject to change at any time.

6. Service interruptions during the trip

If the contract is not fulfilled or not fulfilled properly on site, you are obliged to report this defect to destinationsports, the local representative, the tour guide of the organiser, or the service provider immediately and demand remedial action. If no remedial action is taken within a reasonable period of time during the trip and the defect is significant, you are entitled to take remedial action yourself. If you have complained about the defect and received written confirmation of the complaint, destinationsports will reimburse you for the costs incurred as a result of the defect and proven by receipts within the scope of the originally agreed trip. If no remedy is possible or if the defect is so serious that you cannot reasonably be expected to continue the trip or remain at the holiday destination, you must request written confirmation from destinationsports, the local representative, or the service provider. However, the local representative and the service provider cannot validly acknowledge any claims for damages. You must submit any claims for reimbursement or damages to destinationsports in writing within one month of the contractual end of the trip. The confirmation of the complaint and any evidence must be enclosed. If you do not report the defects within the specified periods, you forfeit your rights to remedy, self-remedy, reduction of the travel price, termination of the contract, and compensation.

7. Liability

The liability of destinationsports is governed by Articles 14 and 15 of the PRG. destinationsports is not liable for indirect damage (e.g., loss of wages, etc.). In the case of damage that is not personal injury, destinationsports shall be liable up to a maximum of twice the travel price. The special rules under sections 3–6 shall apply. If destinationsports is liable for damage caused by contracted companies (hotels, transport companies, etc.), you must assign your claims for damages to the organiser. destinationsports also accepts no liability:

  • in the event of loss of valuables, cash, jewelry, photo and video equipment, personal effects, etc.
  • in the event of loss, theft, damage, or misuse of checks, credit cards, and similar items
  • for program changes resulting from transport companies not adhering to their schedules
  • for events and excursions at the holiday destination that you have not booked with the tour operator's travel agency or local representative.

Tickets:

destinationsports accepts no liability or additional costs for changes to match dates and kick-off times, e.g. due to TV broadcasts. There is no right of return for booked tickets.

8. Cancellation of the trip by you, transfer of the booking

If you wish to change or cancel a booking or name, you must notify destinationsports in person or in writing, stating the reasons. A processing fee of at least CHF 100 per person booked or CHF 200 per order will be charged. The amount of the processing fees depends on the amount of work involved. Travel insurance does not cover the processing fee. Insurance premiums are non-refundable.

In addition to the processing fees, the following cancellation fees will be charged (as a percentage of the trip price):

  • Up to 61 days before departure: 50%
  • 60 to 46 days before departure 60%
  • 45 to 31 days before departure 70%
  • 30 to 15 days before departure 80%
  • 100% from 14 days before departure and in case of no-show or late arrival on the day of departure

Special cancellation and change conditions apply to groups and special large events. Different cancellation fees can be found on the order confirmation.

Scheduled flights:

Once the ticket has been issued, the airline's fare conditions apply. Changes to the dates/route and name changes are generally considered cancellations or new bookings (costs up to 100% depending on the airline).

Flights football training camps:

The prices for flight bookings for groups or individual travelers to Football are shown separately on the confirmation/invoice. They are not part of the package. Flight bookings are subject to their own, usually stricter conditions for cancellations and rebookings.
